Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of the Health Rockit website at healthrockit.com, the Health Rockit patient portal, and related services (together, the “Service”). Please read them carefully.
1. The Service Is Not Intended for Emergencies
The Service is not appropriate for emergency or urgent care. If you are experiencing a medical emergency, dial 911 immediately or go to the nearest emergency room. If you are in crisis, call or text 988 (Suicide & Crisis Lifeline). Do not use the Service, or wait for a response through the Service, if you believe you have an urgent or emergent medical condition.
2. Agreement with These Terms
By accessing the website, creating an account, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Telehealth Consent.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT CREATE AN ACCOUNT OR USE THE SERVICE.
3. Arbitration Notice
PLEASE READ THIS SECTION CAREFULLY. EXCEPT WHERE PROHIBITED BY LAW AND EXCEPT AS OTHERWISE SET OUT IN THESE TERMS, DISPUTES BETWEEN YOU AND HEALTH ROCKIT MAY BE SUBJECT TO A BINDING, INDIVIDUAL ARBITRATION AGREEMENT, INCLUDING A WAIVER OF YOUR RIGHT TO A TRIAL BY JURY AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING. If arbitration applies to your account, the full arbitration agreement — including the arbitration provider, governing procedures, and an opt-out procedure with its deadline — will be presented to you for review before you complete account creation, and no arbitration terms will bind you unless and until they are presented and accepted there.
4. Health Rockit and the Service
Health Rockit is a telehealth platform operated by Here Brands LLC (“Health Rockit,” “we,” “us,” or “our”). The Service provides technology that connects patients with independent, licensed healthcare providers for online consultations and, where a provider determines treatment is medically appropriate, coordinates fulfillment of prescriptions through licensed pharmacy partners.
“Content” means all text, graphics, images, and other material made available through the Service. Content is provided for general informational purposes and is not medical advice. Health Rockit does not practice medicine, does not provide medical consultations, and does not dispense medication.
5. Acceptance and Changes to These Terms
We may modify these Terms from time to time. When we do, we will update the effective date above and post the revised Terms on this page. Your continued use of the Service after revised Terms are posted constitutes your acceptance of the changes. If you do not agree to a change, you must stop using the Service.
6. Eligibility
To use the Service, you must:
- Be at least 18 years of age. The Service is not intended for anyone under 18. If care is sought for a minor, a parent or legal guardian must contact us first; do not create an account on a minor’s behalf.
- Be physically located, at the time of your consultation, in a U.S. state where the Service is available. Health Rockit serves patients in 47 states and does not currently serve California, South Carolina, or New Jersey. See our Compliance page for the current list; availability may change based on provider licensure and regulatory requirements.
- Provide accurate, current, and complete information during intake and keep your account information up to date. Providing false or incomplete health information can result in inappropriate care and is grounds for termination of your account.
7. Your Relationship with Us
Health Rockit is a technology platform only. By using the Service you enter into a direct customer relationship with Health Rockit; you are not establishing a provider-patient relationship with Health Rockit.
- Providers. Clinical consultations, medical review, and all prescribing decisions are provided by independent licensed physicians, physician associates, and nurse practitioners (“Providers”) engaged through the LocumTele network (locumtele.org). Any provider-patient relationship is between you and your Provider, not Health Rockit.
- Pharmacies. Prescriptions are filled by licensed pharmacy partners, including Rush Pharmacy (rushpharmacy.com). You are always free to obtain your prescription from any pharmacy of your choice by contacting support and notifying your prescribing healthcare professional, and your prescription may be transferred accordingly.
8. Medical Disclaimer
The Service and its Content do not constitute medical advice, diagnosis, or treatment, and are not a substitute for professional medical advice from a provider who has examined you. Never disregard or delay seeking professional medical advice because of something you read on the Service. Telehealth has inherent limitations, described in our Telehealth Consent, and not every condition can be diagnosed or treated through the Service. Health Rockit makes no representation that any treatment will be appropriate or effective for you, and no outcome is promised or guaranteed.
9. Prescriptions Are at Provider Discretion
All treatments available through the Service, including compounded Semaglutide / Cyanocobalamin and Tirzepatide / Cyanocobalamin, are subject to individual medical review. A Provider licensed in your state reviews every intake, and prescriptions are issued only when the Provider determines treatment is medically appropriate for you, in the Provider’s sole professional judgment and subject to clinical eligibility criteria and the laws of your state. Use of the Service does not guarantee that any medication will be prescribed. Compounded medications are prepared by licensed pharmacies and are not FDA-approved drugs; your Provider will discuss whether treatment is right for you.
10. Payment; No Charge Without Approval
The Service is a cash-pay service. Pricing for treatment plans is presented during your secure online visit before any commitment, and any charge for medication applies only after a Provider approves your treatment plan. If a Provider determines treatment is not medically appropriate for you, no prescription is issued and you are not charged for medication.
You are responsible for the full amount of costs associated with your use of the Service, including prescriptions. Health Rockit does not accept insurance, and no claims will be submitted to Medicare, Medicaid, or any other government or commercial insurer on your behalf. Payment terms, accepted payment methods, and the timing of any charges will be presented to you within the patient portal before you commit to anything.
11. Refunds and Cancellations
Because a licensed Provider must individually review every intake, not everyone who applies will be approved for treatment. If you are not approved, you are not charged for medication. If you wish to cancel or have a billing question after approval, contact our support team through the contact form and we will review your request; refund eligibility for prescriptions that have already been prepared or shipped may be limited by pharmacy and state regulations.
12. Acceptable Use
You agree to use the Service only for your own personal, lawful, non-commercial use. You will not misrepresent your identity or health information, use the Service on behalf of another person (except as a parent or legal guardian who has contacted us as described above), attempt to obtain medication for resale or distribution, interfere with the operation or security of the Service, or scrape, copy, or reuse Content without our written permission. We may suspend or terminate accounts that violate these Terms.
13. Disclaimer of Warranties; Limitation of Liability
THE SERVICE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HEALTH ROCKIT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEALTH ROCKIT AND HERE BRANDS LLC, AND THEIR OFFICERS, EMPLOYEES, AND AGENTS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. HEALTH ROCKIT IS NOT LIABLE FOR THE PROFESSIONAL ACTS OR OMISSIONS OF INDEPENDENT PROVIDERS OR PHARMACIES, WHO ARE SOLELY RESPONSIBLE FOR THE CARE AND SERVICES THEY PROVIDE. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, AND SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
14. Indemnification
You agree to indemnify and hold harmless Health Rockit and Here Brands LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Service, or your provision of false or incomplete information.
15. Governing Law
These Terms are governed by applicable U.S. federal law and by the laws of the state in which Here Brands LLC is organized, without regard to conflict-of-law rules, except where superseded by any arbitration agreement presented at account creation or by mandatory consumer-protection law in your state of residence.
16. Contact
Questions about these Terms can be sent through the contact form on our home page. This channel is for general and account questions only — do not include medical details, and do not use it for anything urgent. For information about how we handle your data, see our Privacy Policy; for how telehealth care works, see How It Works and our Telehealth Consent.
